We’ve written the legal version of our Terms of Use below, but here’s the gist:

Ask Yawn is here to support you, not replace a professional or your intuition. Our chat is powered by AI, which means it’s smart but not perfect so always use your judgment and reach out to a professional when needed. It is your responsibility to apply reasoning and judgement to the suitability of the information as it applies to your own child or the child in your care. Sense check the content, don't just follow it blindly (same as if you had received the advice from someone else).

 

Any info you share is voluntary and exclusively used to personalise your experience and improve our service (never sold), and you can leave any time — no stress. You can delete all your data anytime too.

By using Ask Yawn or The Village, you’re agreeing to be kind, respectful, and honest, and you understand that things might not always be perfect (we're still learning too). If something doesn’t feel right, reach out — we’re here for you.

TERMS OF USE

Welcome to Ask Yawn Pty Ltd ("Ask Yawn", "we", "us", or "our"). These Terms of Use ("Terms") govern your use of our services, including Ask Yawn (the AI chat-based parenting assistant), The Village (our online community), and any other related services provided via our website at askyawn.com (the "Site"). By accessing or using any part of our services, you agree to be bound by these Terms.

 

1. Overview of services

1.1 Ask Yawn: An AI-powered chat-based platform providing tailored parenting support and guidance for caregivers of children under 6 years of age.

1.2 The Village: An online community hosted on Mighty Networks that offers peer support, moderated discussions, and shared parenting insights.

1.3 Website Access: General browsing of our public-facing website is free and provides information about our services, philosophy, and community.

 

2. Accounts and access

2.1 Account Creation: To access Ask Yawn or The Village, you must create an account. You agree to provide accurate, current, and complete information.

2.2 Eligibility: You must be at least 18 years old to use our services. The services are intended for caregivers seeking parenting guidance for children under 6.

2.3 Subscription & Trial:

  • Ask Yawn (the chat platform) is a paid service, with an optional 7-day trial

  • The Village (the community) is free to access with an Ask Yawn account.

2.4 Cancellation: Subscriptions can be cancelled anytime. You’ll retain access until the end of your current billing cycle. 

 

3. Privacy and data

3.1 Personal Data: We collect and store personal and parenting-related information you provide to enhance your experience.

3.2 Data Use: Data may be anonymised and used to improve our service, content, and recommendations. We do not sell user data.

3.3 Encryption & Confidentiality: Chat data is encrypted and treated with strict confidentiality. However, some admin team members may access anonymised conversations for quality assurance and product improvement.

3.4 Community Behaviour: The Village is moderated. Users must follow community guidelines and agree to behave respectfully. We reserve the right to remove any content or user that breaches these standards.

 

4. Disclaimer and limitations

4.1 General Disclaimer: Ask Yawn provides information only. It does not replace professional medical, legal, psychological, or expert advice. Always consult qualified professionals when needed.

4.2 Not Medical Advice: If medical advice appears, disregard it and report it. We encourage users to seek guidance from a medical professional for any health-related concerns.

4.3 Use of AI: Responses are generated by artificial intelligence trained on publicly available and licensed information with a bias toward expert-backed and evidence-based content. However, inaccuracies may occur. Use your judgment and consult other resources where needed.

4.4 User Responsibility: You are responsible for assessing whether advice or suggestions are suitable for your child. By using our services, you agree to apply common sense and not treat content as absolute or final.

4.5 Limitation of Liability: To the maximum extent permitted by law, Ask Yawn Pty Ltd disclaims all liability for any loss or damage arising from reliance on our services. This includes direct, indirect, incidental, or consequential damages.

4.6 Service Availability: While we aim to provide a consistent and reliable experience, Ask Yawn may be unavailable from time to time due to updates, technical issues, or third-party service disruptions. We are not liable for any interruptions, data loss, or inconvenience caused by such downtime.

4.7 AI Technology: Ask Yawn uses artificial intelligence to provide informational responses. This technology may occasionally produce incorrect, outdated, or incomplete information. We do not guarantee the accuracy of responses and recommend using your judgment or seeking professional advice where appropriate.

 

5. User conduct and community 

5.1 Prohibited Behaviour: No spamming, trolling, misinformation, harassment, or illegal content. Users must not attempt to disrupt or reverse engineer our technology.

5.2 Moderation Rights: We may suspend or remove users from Ask Yawn or The Village at our discretion for violations of these Terms.

5.3 User-Generated Content:  By posting in The Village or submitting any content (text, images, feedback), you grant Ask Yawn a worldwide, royalty-free, non-exclusive licence to use, reproduce, and display that content for community-related or promotional purposes, unless you request its removal.

 

6. Intellectual Property

6.1 All content, branding, and intellectual property associated with Ask Yawn and The Village is owned by Ask Yawn Pty Ltd. Users may not reproduce, distribute, or exploit our materials without permission.

 

7. Payment terms

7.1 Subscription fees are billed monthly. Prices may vary by region.

7.2 Users are entitled to a refund upon request. 

 

8. Jurisdiction and compliance

8.1 This agreement is governed by the laws of New South Wales, Australia. Disputes will be handled in NSW courts.

8.2 Global Privacy Standards: Ask Yawn complies with GDPR, Australian Privacy Principles, HIPAA-style standards, and other global privacy regulations to the best of our ability.

8.3 External Platforms: Our services rely on third-party platforms including Streamlit, Mighty Networks, Stripe, PayPal, and OpenAI. While we choose partners carefully, we are not responsible for issues that arise from their systems.

8.4 Spam Act and Consent: We comply with the Australian Spam Act 2003 and global equivalents. You will only receive marketing messages if you give clear consent, and you may unsubscribe at any time.

8.5 Not a Health Provider: Ask Yawn is not a medical, clinical, or emergency service. We do not provide health services or hold professional registrations in any jurisdiction.

 

9. Changes to the terms

We may update these Terms at any time. Users will be notified of material changes. Continued use of the services constitutes acceptance of the updated Terms.
