Any information you share is voluntary, used only to personalise your experience and improve our service, and never sold. You can delete your data and leave at any time.
If we list an expert in our directory, that expert is an independent professional. Ask Yawn is a directory service - we are not responsible for the advice or conduct of listed experts. You can report poor conduct to support@askyawn.com
By using Ask Yawn, the Community, or Find an Expert, you agree to be kind, honest, and reasonable - and you understand that we're building something genuinely useful and still learning too. If something doesn't feel right, reach out at support@askyawn.com.
1. Overview of services
1.1 Ask Yawn (the app)
An AI-powered parenting support platform providing tailored guidance for caregivers of children aged 0 to 5. Available on iOS (App Store), Android (Google Play), and via web browser.

1.2 The Community
Our Facebook community - Baby Sleep Training Tips & Help - is a free-to-join peer support space moderated by the Ask Yawn team. It is hosted on Facebook and subject to Facebook's own terms and community standards in addition to ours. You can find the community at: https://www.facebook.com/share/g/18vjdgqohr/

1.3 Find an expert
A directory of independent sleep consultants and early childhood professionals. Listings are passive - experts are not employees or contractors of Ask Yawn. Ask Yawn provides a platform for visibility only. Booking and advisory services are conducted directly between the parent and the expert.

1.4 For employers
Ask Yawn offers a workplace wellbeing product that provides employees with access to the Ask Yawn platform via employer-arranged subscriptions, along with anonymised, aggregated reporting to the employer on usage and optional self-reported wellbeing indicators. These terms apply to both the employer entity and the individual employee users.

1.5 Website
General browsing of askyawn.com is free and provides information about our services, philosophy, and community.

2. Accounts and access
2.1 Account creation
To access Ask Yawn or the employer dashboard, you must create an account. You agree to provide accurate, current, and complete information and to keep your account details up to date.

2.2 Eligibility
You must be at least 18 years old to use our services. The platform is intended for caregivers of children aged 0 to 5.

2.3 Subscription and trial
Ask Yawn is a paid subscription service at $9.99 AUD per month, with an optional 7-day free trial for new users. The Community is free to access. Find an Expert is free for parents to browse.

2.4 Employer access
Employers who arrange access for employees agree to these Terms on behalf of their organisation. Individual employee users also agree to these Terms when creating their account. Employer reporting is limited to anonymised, aggregated usage data and any wellbeing indicators voluntarily and explicitly self-reported by employees. No individual-level data is shared with employers.

2.5 Cancellation
Subscriptions can be cancelled at any time. You will retain access until the end of the current billing period.

3. Find an expert - terms for parents
3.1 Directory only
The Find an Expert directory lists independent professionals for informational purposes. Ask Yawn does not employ, endorse, or warrant any listed expert. Inclusion in the directory is not a recommendation.

3.2 Your responsibility
It is your responsibility to independently assess the suitability, qualifications, and conduct of any expert you engage. Ask Yawn is not a party to any arrangement between a parent and a listed expert and accepts no liability for the advice, conduct, or outcomes arising from those engagements.

3.3 Traffic and attribution
Links to expert profiles or external websites within the directory may be UTM-tracked links. This allows Ask Yawn to measure referral traffic and report performance back to listed experts. No personal identifying information is embedded in those links. They link to the Expert's website, socials and booking links only in order to understand traffic from Yawn to the Expert.

3.4 Reporting issues
If you have a concern about a listed expert, contact us at support@askyawn.com. We will review concerns and may remove listings at our discretion.
4. Find an expert - terms for listed experts
4.1 Listing agreement
By submitting a listing for inclusion in the Find an Expert directory, you confirm that you are an independent professional and that all information provided - including qualifications, credentials, and contact details - is accurate and current. You are responsible for keeping your listing up to date.

4.2 Credential verification
Ask Yawn may conduct spot checks of listed credentials. Providing false or misleading information is grounds for immediate removal from the directory. Ask Yawn reserves the right to remove any listing at any time without notice.

4.3 Indemnity
As a listed expert, you agree to indemnify, defend, and hold harmless Ask Yawn Pty Ltd, its directors, employees, and agents from and against any claim, damage, liability, cost, or expense (including legal fees) arising out of or relating to: (a) your advice, services, or conduct; (b) any inaccuracy in your listing; or (c) any dispute between you and a parent or caregiver. Ask Yawn's role is limited to operating a directory. All professional and advisory responsibility remains entirely with the listed expert.

4.4 No employment or agency
Your listing does not create any employment, partnership, joint venture, or agency relationship between you and Ask Yawn. You act at all times as an independent professional.

4.5 Traffic reporting
Ask Yawn may use UTM links and referral data to provide you with periodic traffic performance reports. This data reflects visits and clicks attributed to your listing and is provided as a value-added service.

4.6 Future booking functionality
Ask Yawn may in the future introduce in-app booking functionality. If and when this is introduced, separate commercial terms will apply to any transaction processing. Expert listings do not create any entitlement to participate in booking functionality, and Ask Yawn reserves the right to offer that feature selectively.

5. Privacy and data
5.1 Personal data
We collect and store personal and parenting-related information you provide to personalise your experience and improve our service.

5.2 Data use
Data may be anonymised and used to improve our service, content, and recommendations. We do not sell user data. We may look at themes in the anonymised data in order to provide targeted support to our community and users.

5.3 Employer reporting
For users accessing Ask Yawn through an employer arrangement, anonymised and aggregated usage data - limited to login frequency over time - may be shared with the employer. Any additional wellbeing indicators are self-reported, voluntary, and clearly presented as optional at the point of collection. No individual-level data is shared.

5.4 Chat data
Chat data is encrypted and treated with strict confidentiality. Some admin team members may access anonymised conversations for quality assurance and product improvement purposes only.

5.5 Community behaviour
The Community is moderated. Users must follow community guidelines and agree to behave respectfully. We reserve the right to remove content or users who breach these standards.

6. Disclaimers and limitations
6.1 General disclaimer
Ask Yawn provides information only. It does not replace professional medical, legal, psychological, or expert advice. Always consult qualified professionals when needed.

6.2 Not medical advice
Ask Yawn is not a medical, clinical, or emergency service and does not hold professional registrations in any jurisdiction. If content that appears to constitute medical advice is generated, disregard it, do not act on it, and report it to us.

6.3 AI-generated content
Responses are generated by artificial intelligence trained on publicly available and licensed information, with a bias toward expert-backed, evidence-based content. Inaccuracies may occur. Use your judgment, and consult other resources where needed. You are responsible for assessing whether any suggestion is appropriate for your child.

6.4 User responsibility
By using our services, you agree to apply common sense and not treat any content as absolute or final. The same critical thinking you would apply to advice from any other source applies here.

6.5 Limitation of liability
To the maximum extent permitted by law, Ask Yawn Pty Ltd disclaims all liability for any loss or damage arising from reliance on our services, the Community, or the Find an Expert directory. This includes direct, indirect, incidental, or consequential damages.

6.6 Expert directory liability
Ask Yawn operates as a passive directory only. We accept no liability for the professional advice, conduct, or services of any listed expert. All responsibility for professional engagements lies solely with the relevant expert. Parents engage listed experts at their own discretion and risk.

6.7 Service availability
While we aim to provide a consistent and reliable experience, Ask Yawn may be unavailable from time to time due to updates, technical issues, or third-party service disruptions. We are not liable for any interruptions or data loss caused by such downtime.

7. User conduct
7.1 Prohibited behaviour
No spamming, trolling, misinformation, harassment, defamation, or illegal content. Users must not attempt to disrupt, reverse engineer, or exploit our technology or systems.

7.2 Moderation rights
We may suspend or remove users from Ask Yawn or the Community at our discretion for violations of these Terms.

7.3 User-generated content
By posting in the public online Community or submitting any content to our team, you grant Ask Yawn a worldwide, royalty-free, non-exclusive licence to use, reproduce, and display that content for community-related or promotional purposes, unless you request its removal.

8. Intellectual property
All content, branding, and intellectual property associated with Ask Yawn is owned by Ask Yawn Pty Ltd. Users and listed experts may not reproduce, distribute, or exploit our materials without prior written permission.

9. Payment and refunds
9.1 Subscription fees
Subscriptions are billed monthly at $9.99 AUD. Prices may vary by region. Billing is processed through Stripe.

9.2 Refund policy
You are entitled to a refund upon request. To request a refund, email support@askyawn.com from the email address associated with your account. We will process your request promptly.

10. Jurisdiction and compliance
10.1 Governing law
These Terms are governed by the laws of New South Wales, Australia. Disputes will be handled in NSW courts.

10.2 Privacy compliance
Ask Yawn complies with the Australian Privacy Principles, GDPR, and other applicable global privacy regulations to the best of our ability.

10.3 Third-party platforms
Our services rely on third-party platforms including Stripe, PayPal, OpenAI, Wix, and others. While we select partners carefully, we are not responsible for issues arising from their systems or terms.

10.4 Spam Act compliance
We comply with the Australian Spam Act 2003 and equivalent global legislation. You will only receive marketing communications if you have given clear consent, and you may unsubscribe at any time.

11. Changes to these terms
We may update these Terms at any time. Users will be notified of material changes. Continued use of our services following notification constitutes acceptance of the updated Terms.
